1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of our website located at oakbridgerestoration.com (the "Website") and the restoration and construction services we provide. By accessing or using our Website or engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or services.

Oak Bridge provides comprehensive restoration and construction services, including but not limited to:

3. Service Areas
We currently provide services in the following areas:
- Tuscaloosa, Alabama and surrounding communities including Northport, Cottondale, Brookwood, Vance, and Moundville
- Birmingham, Alabama metropolitan area including Mountain Brook, Homewood, Vestavia Hills, Hoover, Pelham, Alabaster, Helena, and Indian Springs
- Additional areas within Alabama as determined on a case-by-case basis
4. Estimates and Contracts
4.1 Estimates
All estimates provided by Oak Bridge are approximations based on the information available at the time of assessment. Actual costs may vary based on unforeseen conditions, changes in scope, material price fluctuations, or additional work required. We will make reasonable efforts to notify you of any significant changes to estimated costs before proceeding with additional work.
4.2 Written Agreements
All services will be provided pursuant to a written contract or work authorization signed by both parties. The terms of the written agreement will govern the specific services to be provided, including scope of work, timeline, payment terms, and warranties.
5. Payment Terms
Payment terms will be specified in the written contract for each project. Generally:
- Deposits may be required before work commences
- Progress payments may be required at specified milestones
- Final payment is due upon project completion and acceptance
- Late payments may be subject to finance charges as permitted by Alabama law
For insurance-related projects, payment terms may be coordinated with insurance claim disbursements.
6. Insurance Claims
When we work with your insurance company, we will assist in documenting damages, communicating with adjusters, and helping to maximize your claim coverage. However, we are not responsible for your insurance company's decisions regarding coverage, claim approvals, or payment amounts. You remain responsible for any amounts not covered by your insurance, including deductibles and any coverage limitations.
7. Project Timelines
Project timelines are estimates based on normal working conditions. Actual completion dates may be affected by weather conditions, material availability, unforeseen site conditions, changes to project scope, delays in obtaining necessary permits or approvals, or other circumstances beyond our reasonable control. We will make reasonable efforts to complete projects in a timely manner and to communicate any anticipated delays.
8. Changes to Scope of Work
Any changes to the agreed-upon scope of work must be documented in writing and may result in adjustments to the contract price and timeline. We will provide you with a written change order detailing any additional costs and timeline impacts before proceeding with changed or additional work, except in emergency situations where immediate action is necessary to prevent further damage.
9. Site Access and Preparation
You agree to:
- Provide Oak Bridge with reasonable access to the work site during normal business hours
- Remove or protect personal property and valuables from work areas
- Disclose any known hazardous materials or conditions on the property
- Ensure utilities are available as needed for the work
- Comply with any reasonable site requirements we communicate to you
10. Warranties and Guarantees
10.1 Workmanship Warranty
We warrant that our work will be performed in a professional and workmanlike manner in accordance with industry standards. Specific warranty terms and duration will be detailed in your project contract. This warranty does not cover damage resulting from normal wear and tear, improper maintenance, abuse, alterations by others, or acts of nature.
10.2 Manufacturer Warranties
Materials and equipment installed by Oak Bridge may be covered by manufacturer warranties. We will provide you with available manufacturer warranty information. Claims under manufacturer warranties must be pursued directly with the manufacturer, though we will assist you in reasonable ways with such claims.
11. Limitation of Liability
11.1 General Limitations
TO THE MAXIMUM EXTENT PERMITTED BY ALABAMA LAW, OAK BRIDGE'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO ANY PROJECT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO OAK BRIDGE FOR THE SPECIFIC PROJECT GIVING RISE TO THE CLAIM.
11.2 Consequential Damages
TO THE MAXIMUM EXTENT PERMITTED BY ALABAMA LAW, OAK BRIDGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11.3 Pre-Existing Conditions
We are not liable for pre-existing conditions, hidden defects, or code violations that are discovered during our work but were not caused by our work. We will notify you of such conditions, but correction of these conditions is not included in our scope of work unless specifically agreed upon in writing.
12. Indemnification
You agree to indemnify, defend, and hold harmless Oak Bridge, its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms or any contract with us; (b) your misuse of our services; (c) your violation of any law or regulation; or (d) undisclosed pre-existing conditions or hazards on your property, except to the extent caused by our negligence or willful misconduct.
13. Insurance
Oak Bridge maintains general liability insurance and workers' compensation insurance as required by Alabama law. Proof of insurance is available upon request. You are responsible for maintaining appropriate property insurance on your property.
14. Permits and Compliance
Unless otherwise specified in the written contract, Oak Bridge will be responsible for obtaining necessary building permits for the work we perform. You are responsible for ensuring that the project complies with any homeowners association rules, deed restrictions, or other private restrictions. We will perform work in compliance with applicable building codes and regulations, but we are not responsible for bringing pre-existing conditions into compliance unless specifically contracted to do so.
15. Cancellation and Termination
15.1 Cancellation by Client
You may cancel a project by providing written notice. If you cancel after work has commenced, you will be responsible for payment for all work completed, materials ordered or purchased, and reasonable cancellation costs. Deposits may be non-refundable as specified in the contract.
15.2 Termination by Oak Bridge
We reserve the right to terminate a project if: (a) you fail to make required payments; (b) you fail to provide necessary site access; (c) you materially breach the contract; (d) unsafe conditions are discovered that you refuse to remedy; or (e) continuation of work becomes impossible or impracticable. We will provide written notice of termination and you will be responsible for payment for all work completed and materials purchased through the termination date.
16. Dispute Resolution
16.1 Governing Law
These Terms and any disputes arising out of or related to our services shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles.
16.2 Venue and Jurisdiction
Any legal action or proceeding arising out of or related to these Terms or our services shall be brought exclusively in the state or federal courts located in Tuscaloosa County, Alabama, and you consent to the personal jurisdiction of such courts.
16.3 Informal Resolution
Before initiating any legal proceeding, the parties agree to attempt to resolve disputes through good faith negotiation. Either party may provide written notice of a dispute to the other party, and the parties will meet and attempt to resolve the matter within 30 days of such notice.
17. Emergency Services
We provide 24/7 emergency response services. In emergency situations involving active water intrusion, fire damage, or other immediate threats to property, we may take necessary immediate action to prevent further damage, even before a formal contract is signed. You authorize such emergency work by requesting our emergency services and will be responsible for payment of reasonable charges for emergency mitigation work performed.
18. Website Use
18.1 Intellectual Property
All content on our Website, including text, graphics, logos, images, and software, is the property of Oak Bridge or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our Website content without our written permission.
18.2 Prohibited Uses
You agree not to use our Website:
- For any unlawful purpose or in violation of any applicable law
- To transmit any harmful code, viruses, or malicious software
- To interfere with or disrupt the Website or servers
- To collect information about other users without their consent
- To impersonate any person or entity
18.3 Website Accuracy

19. Subcontractors
We may use qualified subcontractors to perform portions of the work. We are responsible for the work performed by our subcontractors as if we had performed it ourselves. All subcontractors will be properly licensed and insured as required by Alabama law.
20. Force Majeure
Neither party shall be liable for delays or failure to perform obligations due to causes beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, labor disputes, material shortages, or public health emergencies. In such events, the affected party will notify the other party promptly and performance will be excused for the duration of the force majeure event.
21. Entire Agreement
For specific projects, these Terms together with the written contract or work authorization constitute the entire agreement between you and Oak Bridge regarding the services provided and supersede all prior or contemporaneous communications and proposals, whether oral or written. In the event of any conflict between these Terms and a written contract, the written contract shall control.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
23. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver shall be effective unless made in writing and signed by an authorized representative of Oak Bridge.
24. Assignment
You may not assign or transfer your rights or obligations under these Terms or any contract with us without our prior written consent. We may assign our rights and obligations to a successor in interest in connection with a merger, acquisition, or sale of assets.

26. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our Website with a revised "Last Updated" date. Your continued use of our Website or services after changes are posted constitutes acceptance of the modified Terms. For ongoing projects, the Terms in effect at the time the contract was signed will govern that project.
